Maryland security deposit law
Short answer: A Maryland landlord has 45 days after the tenancy ends to return the deposit plus interest, and to mail an itemized list of damages and costs for anything kept. Deposits are capped at one month's rent.
| Deadline to return the deposit | 45 days after the tenancy ends. |
|---|---|
| Limit on how much a landlord can charge | One month's rent per unit, no matter how many tenants. Up to two months' rent is allowed only if the tenant qualifies for state utility assistance, pays utilities directly to the landlord, and both agree in writing. |
| Itemized list of deductions | Yes. A written list of damages with an itemized statement of the costs, sent by first-class mail to the tenant's last known address within 45 days. |
| Interest on the deposit | Yes, on deposits of $50 or more held at least 6 months: simple interest at the 1-year U.S. Treasury rate (as of the first business day of each year) or 1.5% a year, whichever is greater. |
| Penalty if the landlord breaks the rules | A landlord who keeps any part of the deposit without a reasonable basis can owe up to three times the amount withheld, plus attorney's fees. Missing the 45-day damage list means losing the right to keep anything for damage. Charging more than the cap can cost up to three times the extra amount. |
| What the tenant has to do | To be present at the move-out inspection, send the landlord a certified-mail notice at least 15 days before moving, with your move date and new address. |
| The law | Maryland Code, Real Property Section 8-203 |

Good to know
- The deposit must be put in a Maryland branch of a federally insured bank, in an interest-bearing account used only for deposits, within 30 days.
- The landlord must give a receipt for the deposit, included in the written lease.
- A tenant may buy a surety bond instead of some or all of the deposit, but the bond plus any deposit can't exceed two months' rent.
Tips for landlords
- Do a written move-in inspection and have the tenant sign it. Take dated photos of every room, including inside appliances and closets.
- Collect the tenant's forwarding address in writing at move-out.
- Put the itemized list and the refund in the mail well before the deadline, and keep proof of mailing.
- Normal wear and tear (faded paint, light carpet wear, small nail holes) usually can't be charged. Damage beyond that can.
Tips for tenants
- Take your own dated photos and video on move-in day and move-out day.
- Give your landlord your forwarding address in writing, and keep a copy.
- If the deadline passes, send a written demand letter that cites the law above before going to small claims court.
